We hope you’re keeping cool in the summer heat, dear reader. Today, in addition to our usual federal court updates, we’re going to compare the 2025 term to past SCOTUS terms. Let's gavel in!

Grants

SCOTUS has accepted one new case to its merits docket since our July 13 issue. The court has accepted 25 cases for the 2026–2027 term.

Nominations

President Donald Trump (R) has not announced any new Article III nominees since our July 13 edition.

Committee action

The Senate Judiciary Committee has reported seven new nominees out of committee since our July 13 edition.

Confirmations

The Senate has confirmed eight nominees since our July 13 issue.

Arguments

The U.S. Supreme Court has heard an average of 60 arguments since the 2021 term. The following table shows the number of arguments SCOTUS has heard over the past five terms. 

5-4 Opinions by term

The U.S. Supreme Court has released an average of 7.4 5-4 decisions since the 2021 term. The following table shows the number of 5-4 opinions SCOTUS has released over the past five terms. 

Decisions issued by year

The U.S. Supreme Court has issued an average of 63 decisions since the 2021 term. The following table shows the number of opinions SCOTUS has released over the past five terms.

Vacancies

The federal judiciary currently has 24 vacancies, all of which are for lifetime Article III judgeships. As of publication, there were eight pending nominations.

According to the Administrative Office of U.S. Courts, there were 13 upcoming vacancies in the federal judiciary, where judges have announced their intention to leave active judicial status.
